Terms and Conditions

A. RATES | OVERAGES | PAYMENT POLICY

  1. Rental rates are determined based on the current Rental Rate Sheet in effect at the time of booking and are subject to change without prior notice.

  2. Rental periods are fixed at the time of booking. The rental time starts and ends punctually as scheduled, including set up and break-down time. The studio must be cleaned and vacated by the end of the rental period.

  3. Any equipment or props drop-off or pick-up after the shoot must be negotiated and agreed upon during the rental contract process, and additional fees may apply.

  4. Early or extended rental hours must be arranged and paid for in advance before the rental period begins.

B. CANCELLATION POLICY

  1. Rental time of 1-2 hours requires a minimum of 48 hours notice for cancellation.

  2. Rental time of 4-6 hours requires a minimum of 72 hours notice for cancellation.

  3. Rental time of 8 or more hours in one booking requires a minimum of 7 days notice for cancellation.

  4. Any rental block exceeding 5 days with 6-8 hours per day requires a minimum of 2 weeks notice for cancellation.

C. LATE ARRIVALS AND NO SHOWS POLICY

1. Late Arrivals
    A. Up to 15 minutes late:  No penalty, but rental time will not be extended.
    B. 15-30 minutes late: Rental time will not be extended.
    C. More than 30 minutes late: Rental time will not be extended, and the booking may be canceled at our discretion.

2. No Shows
    A. If a client fails to arrive within 1 hour of the scheduled start time without prior notification, the booking will be considered a no show.
    B. A fee may be applied for no shows based on the duration and impact of the booking.
    C. For bookings longer than 4 hours, a no show fee may be applied.

3. Notification
    A. Clients must notify us as soon as possible if they anticipate being late. Depending on availability, we may be able to accommodate changes, but additional fees may apply.

4. Rescheduling
    A. Clients who arrive late or fail to show up may request to reschedule their booking. Rescheduling is subject to availability and additional fees may apply.
    B. If rescheduling is not possible, the cancellation policy will be enforced as outlined in section B.

 

D. REFUND POLICY

We do not offer refunds for any bookings or services. Instead, a credit will be applied to the client's account for future bookings in the event of a cancellation or issue with a booking. This credit is valid for up to 12 months from the date of the original booking and can be applied towards any rental or service offered by our company. Clients must inform us at the time of booking to use a credit. Credits are non-transferable and can only be used by the account holder. In exceptional circumstances, we may consider requests on a case-by-case basis, but the standard policy is no refunds.

E. TERMS OF USE

  1. Photographer acknowledges that any dangerous, pornographic, or negligent activities on the Premises will result in the immediate cessation of the shoot, with Photographer and their party required to leave the premises. However, Company assumes no responsibility to act in such cases.

  2. Photographer agrees to hold Five Star Pictures Studio, its agents, representatives, and anyone acting on behalf of the Company harmless from any legal actions resulting from the Photographer's conduct.

  3. Photographer is solely responsible for verifying the legal age of any models used during their rental period.

  4. Company reserves the right to end any activities if it becomes aware of legal age violations.

  5. A Company representative will be present in the studio during the Photographer's usage.

F. EXTENSION POLICY

Any requests for additional time will be accommodated on a first-come, first-served basis and must be paid in full before the end of the rental. The Company reserves the right to enforce this policy without exception.

G. ELECTRICAL USAGE | CLEANING & TRASH​

  1. Photographer agrees to leave the Premises and all contents and fixtures in the same condition as they were found upon arrival.

  2. Company will dispose of trash collected in the provided trash cans, while Photographer must remove larger items and personal props.

  3. Disposal of large amounts of garbage due to extensive sets may incur additional costs.

  4. Items left on the Premises for more than 7 days will be considered abandoned and may be discarded or kept by the Company at its discretion.

  5. Failure to return the Premises to its original condition will result in a minimum $175 cleaning fee.

H. STUDIO RULES | CONDUCT

  1. Smoking is strictly prohibited inside the building and within 20 feet of any entrance.

  2. Nudity is not allowed within 15 feet of windows or in clear sight of any property of the City Museum or public places.

  3. Non-prescription drugs, and illegal substances are not permitted on the Premises.

  4. Music/voices should be kept at reasonable levels.

  5. Individuals who are visibly drunk or under the influence of illegal substances will not be admitted.

  6. Pets are not allowed without prior consent from a Studio Manager.

  7. Painting is prohibited anywhere in the studio or building premises.

  8. Photographer is solely responsible for the conduct and welfare of all accompanying individuals.

  9. Company representatives reserve the right to stop the shoot and may require Photographer and their party to leave immediately if dangerous, pornographic, illegal, or negligent activities are observed. Authorities will be alerted to any illegal activities.

I. WAIVER OF LIABILITY | INSURANCE & DAMAGE

  1. Photographer uses the Premises and equipment at their own risk.

  2. Company will not be liable for any direct, indirect, incidental, or consequential damage, injury, or loss to Photographer, their party, or possessions while on the Premises.

  3. Photographer indemnifies and holds harmless Five Star Pictures Studio, its owners, agents, representatives, associates, officers, employees, guests, and tenants against any suits, claims, losses, accidents, judgments, fines, injuries, or damages, including reasonable attorney’s fees.

  4. Photographer is solely responsible for any damage to Company's property or equipment that occurs during the rental period. Damage deposits will be held until repairs are completed. If damage exceeds the deposit amount, Photographer agrees to pay additional repair costs.

J. FORCE MAJEURE (Acts of God/War) | ARBITRATION & MISCELLANY

  1. Force Majeure events, including acts of God, war, natural disasters, strikes, civil disorder, curtailment of transportation facilities, pandemic, outbreak, or government regulations, limit liability for both parties regarding cancellations, damages, losses, or injuries.

  2. If disputes arise, parties agree to submit the matter to binding arbitration, following the commercial arbitration rules of the American Arbitration Association. The arbitration will take place in St. Louis City, Missouri, and each party will be responsible for its share of arbitration fees.

  3. Any modifications to this Agreement must be in writing and signed by both parties.
